Terms and Conditions

1. Scope

The General Terms and Conditions (hereinafter referred to as "GTC") apply to all orders placed through our online shop. The online shop is operated by JSPC International AG.

JSPC International AG reserves the right to change these GTC at any time. The version of these GTC that is valid at the time of the order shall apply, and this version cannot be unilaterally changed for that order. Any terms and conditions of the customer that conflict with or deviate from these GTC will not be recognized.

The offer is valid as long as the product can be found via the search engine in the online shop and/or while stocks last.

Orders can be rejected without justification.

2. Information

Product images in advertisements, brochures, online shop, etc. are for illustration purposes and are non-binding.

All sales prices published in the online shop are final prices that include all taxes (especially VAT), any advance recycling fees (vRG), packaging costs, delivery costs, and any other fees, charges, or costs.

JSPC International AG reserves the right to change the prices of the products and services offered at any time.

3. Contractual Partner, Conclusion of Contract

The products and prices in the online shop are considered an offer. However, this offer is always subject to the resolving condition of an impossibility of delivery or an incorrect price indication.

The purchase contract for products or services from JSPC International AG is concluded with JSPC International AG as soon as the customer places their order in the online shop, in our store, by phone, or by email (hereinafter referred to as "purchase contract").

The receipt of an online order is indicated to the customer by an automatically generated order confirmation from JSPC International AG to the email address provided by the customer. The receipt of the automatically generated order confirmation does not constitute a promise that the product can actually be delivered. It merely indicates to the customer that the order placed in the online shop has been received and thus the contract with JSPC International AG has been concluded under the condition of delivery possibility and correct price indication.

4. Delivery Conditions

We deliver within Switzerland free of shipping costs.

5. Duty to Inspect

The customer must immediately inspect delivered or collected products for correctness, completeness, and delivery damage.

Delivery damage, incorrect and incomplete deliveries must be reported to JSPC International AG within 1 calendar day from the time of collection or delivery. The customer is aware that such a report must be made by email to info@louisxviwatches.com. Such a product must not be put into operation by the customer. It must be kept in the original packaging as received.

6. Warranty

JSPC International AG provides a warranty for defect-free and functional products ordered for 2 years or 5 years (the warranty period for a specific product can be found on the product page) after delivery. The warranty period continues to run regardless of any warranty services provided. JSPC International AG may fulfill the warranty at its discretion through:

- free repair

- partial or complete replacement with an equivalent used product

- credit at the current daily price

Wear and improper handling are excluded from the warranty by JSPC International. Otherwise, the liability exclusions according to section 7 apply.

7. Liability and Disclaimer

Liability is governed by the applicable legal provisions. However, JSPC International AG is not liable in any case for (i) slight negligence, (ii) indirect and consequential damages and lost profits, (iii) unrealized savings, (iv) damage from delivery delays, and (v) any actions and omissions of JSPC International AG's auxiliary persons, whether contractual or non-contractual.

In addition, JSPC International AG disclaims liability in the following cases:

- improper, contractual or unlawful storage, adjustment, or use of the products

- failure to maintain and/or improper modification or repair of the products by the customer or a third party

- force majeure, particularly natural events, moisture damage, impact and fall damage, etc., which are not the fault of JSPC International, and official orders.

JSPC International AG fully excludes any liability for any kind of loss or damage - whether direct, indirect, or consequential - resulting from the use of or access to the JSPC International AG websites or from links to third-party websites. JSPC International does not guarantee that individual parts of their website will function error-free. Furthermore, JSPC International AG disclaims any liability for manipulations of the EDP system of the Internet user by unauthorized persons.

8. Payment

All payment claims for products and services purchased through the online shop of JSPC International are asserted directly by JSPC International AG to the customer.

The following payment methods are available in our shop:

Credit Card

After your authentication as the rightful cardholder, we request your credit card company to initiate the payment transaction immediately after the order. The payment transaction is automatically carried out by the credit card company and your card is charged.

PayPal, PayPal Express

During the ordering process, you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or register first, authenticate with your login details, and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. The payment transaction is carried out automatically by PayPal immediately thereafter. Further information is available during the ordering process.

Prepayment

After completing the order, you will receive the necessary account information by email to execute your payment. Once the payment is credited to our account, your order will be processed further.

TWINT

During the ordering process, you will be redirected to the website of the online provider TWINT. To pay the invoice amount via TWINT, you must be registered there or register first, authenticate with your login details, and confirm the payment instruction to us.

Purchase on Account

During the ordering process, you will be redirected to the website of the online provider Powerpay. A credit check is conducted for which you must provide your gender and date of birth. If the credit check is successful, the order will be completed. If the credit check is unsuccessful, you will be prompted to select another payment method.

Purchase on Account Byjuno

After completing your order, a credit check is conducted. If we need additional information for the check, we will inform you by email. If the credit check is negative, purchase on account cannot be granted. In this case, the payment method of your order will be changed to prepayment.

9. Retention of Title

Ordered products remain the property of JSPC International AG until full payment is made to JSPC International AG.

10. Order Changes or Cancellations

Orders oblige the customer to accept the products and services. Subsequent changes or cancellations of orders by the customer may be accepted by JSPC International AG at its sole discretion and may be subject to a handling fee of 20% of the canceled order value, but at least CHF 60.–, as well as any loss in value of the canceled products since their order.

11. Repairs Outside Warranty

The costs for repairs outside the warranty are borne by the customer. For products that do not exhibit any detectable defects or where the defect is not covered by the warranty, JSPC International reserves the right to charge the customer for the cost of checking the claimed defect and the shipping costs.

12. Data Protection

The privacy policy of Digitec Galaxus applies to the processing of personal data by Digitec Galaxus.

13. Partial Invalidity

If individual provisions of these GTC are invalid or ineffective, this does not affect the validity of the remaining provisions and these GTC as a whole.

14. Jurisdiction and Applicable Law

All legal relationships between JSPC International AG and the customer are subject to substantive Swiss law. For consumer claims, the customer's place of residence or Wollerau SZ is the place of jurisdiction. In all other cases, Wollerau SZ is the exclusive place of jurisdiction.
